THE BOLD BREAK

ASSUMPTION OF RISK AND LIABILITY WAIVER

The individual named below (referred to as "I" or "me") desires to participate in volleyball training and related athletic programs (the "Activities") provided by Maze Model LLC, doing business as “The Bold Break”, a California limited liability company (the "Training Center") at [1834 Soscol Ave Suite c-2, Napa, California 94559] (the "Premises"). In consideration of being permitted by the Training Center to enter the Premises and participate in the Activities and in recognition of the Training Center's reliance hereon, I agree to all the terms and conditions set forth in this agreement (this "Release").

Voluntary Participation:

I acknowledge that my participation in the Activities is voluntary and I am aware these Activities involve inherent risks and dangers that no amount of care, caution, instruction, or expertise can eliminate, which include, but are not limited to, physical or psychological injury, pain, suffering, illness, concussion, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these risks may result from the actions, negligence, or failure to act, by myself, the Training Center, or others. I also understand that there may be risks not known to us or not reasonably foreseeable at this time.

I confirm that I: (a) am in good health and proper physical condition and do not have any medical or other conditions that would impair my ability to participate in the Activities. I will also follow all instructions, recommendations, and cautions of the Training Center at all times while on the Premises or during the Activities. If at any time I believe conditions to be unsafe, or that I am no longer in proper physical condition to participate in the Activities, I will immediately discontinue further participation in the Activities. I acknowledge that the Training Center is relying on these statements to allow me to participate in the Activities.

Assumption of Risk:

I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my child’s participation.

Waiver of Liability:

I, for myself and on behalf of my child, heirs, assigns, personal representatives, and next of kin, agree to release and discharge the Training Center (and Training Center affiliates, related entities, employees, agents, representatives, successors, and assigns) from any and all claims, loss, causes of action, or costs (including, but not limited to, attorney’s fees) arising out of ordinary negligence of Training Center, whether active or passive, or any of Trainers affiliates, employees, agents, representatives, successors, and assigns. This waiver and release of liability includes, without limitation, injuries, illness, death or economic loss which may occur as a result of (a) your child’s use of any training or exercise equipment or facilities which may malfunction or break, (b) improper maintenance of any exercise equipment, premises or facilities, (c) negligent instruction or supervision, (d) negligent hiring or retention of employees and/or (e) slipping or tripping and falling while on any portion of a premises. I acknowledge that the above general release includes claims and costs which I may not know or suspect to exist and hereby waive all rights which may exist under California Civil Code Section 1542, which provides as follows: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Indemnification:

I agree to indemnify and hold harmless the Training Center from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of the Training Center or otherwise.

Medical Authorization:

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless the Training Center from any claim based on such treatment or other medical services.

Miscellaneous

This Release constitutes the sole and entire agreement of the Training Center and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Training Center and me and our respective successors and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in [Napa County ], California and I hereby consent to the exclusive jurisdiction of such courts.

BY SELECTING 'MOVING FORWARD WITH PAYMENT', I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE TRAINING CENTER.
